ACKNOWLEDGEMENT AND ACCEPTANCE OF TERMS

Word & Brown Insurance Administrators, Inc. (referred to herein as “Word & Brown”,
“we” or “our”) understands your concern with privacy and the collection and use of your personal
information while visiting or interacting with the Word & Brown® Website, or any other website
that Company may make available from time to time as well as any mobile application related,
linked, or otherwise connected thereto. (Said websites and mobile application will be collectively
referred to herein as the “Website” unless the particular provision only addresses said mobile
application. In that case, said mobile application will be referred to as the Mobile Application).
We are committed to protecting your privacy. This Privacy Policy sets forth our current privacy
practices with regard to the information we collect when you or your computer or mobile or
wireless electronic device interacts with the Website. By accessing or using the Website or any
related or affiliated site including by clicking to download, install or use the Mobile Application,
you acknowledge that you have read, fully understand, accept and agree to Word & Brown’s
Privacy Policy and knowingly and willingly consent to the information collection, use, and
disclosure practices described in this Privacy Policy. If you do not agree to this Privacy Policy,
you are expressly prohibited from using the Website and you must immediately delete the
Mobile Application from your mobile or wireless electronic device. This Privacy Policy does not
apply to the third party on-line mobile store from whom you install the Mobile Application. We
are not responsible for any data collected by any third party. The amount and type of information
which we receive depends upon how you use the Website

LIMITATION ON SCOPE OF CONTENT

This Website contains information regarding Word & Brown and its services. The services
described in this Website are available only in those states and territories of the U.S. specifically
referred to within the description of each such program. This Privacy Policy does not apply to
Word & Brown’s offline communications, data collection practices or other activities.

quotations for health insurance coverage through Word & Brown’s health plans and to provide
other products and services to our brokers and/or other third-parties. We may share information
with our contracting health plan carriers during the underwriting process, as well as affiliated
businesses, including but not limited to CHOICE Administrators Insurance Services, Inc., as
necessary, to provide services through such companies. Much of the information we receive is a
significant part of our business. In the future, we might buy, sell, exchange, assign, or trade
business assets, which may include this information. In the event that Word & Brown is
acquired, or substantially all of its assets are acquired, our customer information may be one of
the transferred assets to the extent legally permissible. We may also release personal information
when we believe that the release of such information is required by law or is necessary to protect
the rights, property, or safety interests of Word & Brown, or other Website visitors. Word &
Brown may also share personal information, including without limitation, Personally Identifiable
Information (PII), Personal Health Information (PHI), and/or the like with other third party
companies that we have hired or collaborate with to perform services on our behalf.

conform to the Privacy Policy or Terms of Use maintained by Word & Brown. As with the

by Word & Brown. Word & Brown will not be responsible for any harm that you or any person

into the Website and we adhere to the generally accepted standards of security in the industry for the

Word & Brown makes every effort to ensure the secure collection and transmission of sensitive
user information using industry-accepted data collection and encryption methodologies such as
TLS (Transport Layer Security), SSL (Secure Sockets Layer) and FIPS (Federal Information
Processing standards).: however, there is a risk that such information may be illegally
intercepted. We maintain up-to-date physical, electronic, and processing safeguards that restrict
unauthorized access to your information. These security procedures include locked files and
information system security measures such as user passwords, data encryption and firewall
technology. Word & Brown employees are regularly trained on, and are required to comply with
our policies and procedures focused on protecting the confidentiality of your information.

CHILDREN’S ONLINE PRIVACY PROTECTION

The Website is not designed for or intentionally targeted at children thirteen (13) years
of age or younger. The Website complies with the Children’s Online Privacy Protection Act of 1998
(COPPA). COPPA, and its accompanying Federal Trade Commission (FTC) regulation, protects
the privacy of children using the Internet. Word & Brown does not knowingly collect or solicit
PII from children under 13. The Website is not intended to solicit information of any kind from
children under 13, and is designed to block our knowing acceptance of any such information
unless such information is provided by or with the consent of the child’s parents or legal
guardians. It is possible that by fraud or deception we may receive information pertaining to
children under 13. If we are notified of this, as soon as we verify the information, we will
immediately obtain parental consent or otherwise delete the information from our servers. If you

CHANGES TO PERSONALLY IDENTIFIABLE INFORMATION (PII)

You have the right to access and edit the PII that you have provided to us. You may change
any of your PII in your account online at any time by linking to your account in accordance with
instructions posted elsewhere on the Website. You may also access and correct your PII and

unencrypted email. Please include your name, address, and/or e-mail address when you contact

We encourage you to promptly update your PII if it changes. You may request that the
information on your account be deleted or removed, however, because we keep track of past
transactions, you cannot delete information associated with past transactions on this Website. In
addition, it may be impossible to completely delete your information without some residual
information because of backups.

E-NEWS AND PROMOTIONAL E-MAILS

From time-to-time, we may offer free e-newsletters and send out promotional e-mails as a
service to our visitors. We send e-mails only if the user has not opted out from receiving such
communications from Word & Brown or its affiliates through the Website.

disclosed and can be viewed or accessed online in this manner.

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems [and the Mobile Application] include a
Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not
to have data about your online browsing activities monitored and collected. No uniform
technology standard for recognizing and implementing DNT signals has been finalized. As such,
we do not currently respond to DNT browser signals or any other mechanism that automatically
communicates your choice not to be tracked online. If a standard for online tracking is adopted
that we must follow in the future, we will inform you about that practice in a revised version of
this Privacy Policy.

Word & Brown has the right, in its sole and absolute discretion, to update this Privacy
